These Terms of Service ("Terms") govern your access to and use of the website, communications, and notarial services provided by Ambience Notary by Ruth Agbor ("Ambience Notary," "we," "us," or "our"). By booking an appointment, requesting services, or using our website, you agree to these Terms. Please read them carefully.
1.Our Services
Ambience Notary provides notary public services, including mobile notary visits, loan signing agent services, general notary work, business and legal document notarization, and remote online notarization (RON). We serve Forney, the Dallas–Fort Worth metro, and surrounding Texas communities in person, and clients nationwide through RON where permitted by law.
Important: We Are Not Attorneys
A notary public is not an attorney and, unless separately licensed, may not give legal advice, draft legal documents, explain the legal effect of a document, or recommend how you should sign. Our role is limited to verifying identity, confirming willingness and awareness, administering oaths where required, and completing the notarial act. If you need legal guidance, please consult a licensed attorney. Performing acts beyond a notary's authority would constitute the unauthorized practice of law, which we will not do.
2.Your Responsibilities
To allow us to perform a valid notarization, you agree that:
- You will present a current, valid, government-issued photo ID (such as a driver's license, state ID, passport, or military ID);
- You will not sign the document before the appointment — the notary must witness your signature;
- You are signing willingly, are aware of the contents of your document, and appear to have the capacity to do so;
- Any additional required signers or witnesses will be present with their own valid identification; and
- The information you provide to us is accurate and complete.
3.Identity Verification & Remote Online Notarization
For RON appointments, identity is confirmed through credential analysis of your photo ID and knowledge-based authentication, and the session is recorded as required by applicable state law. To participate, you will need a device with a camera and microphone, a stable internet connection, and a valid photo ID. By using RON, you consent to the recording and secure retention of the session as described in our Privacy Policy.
4.Fees & Payment
The maximum per-signature notarial fee is set by Texas law. For mobile, after-hours, and remote services, we charge an additional travel or convenience fee that reflects time, distance, and scheduling. You will always receive a clear quote before your appointment is confirmed, and there are never hidden charges.
- Pricing displayed on our website is an estimate; final pricing depends on the number of signatures, travel distance, document type, and timing.
- Payment is due at the time of service unless otherwise agreed in writing.
- Travel and convenience fees are charged for the notary's time and travel and remain payable even where a notarization cannot be completed for the reasons described in Section 6.
5.Scheduling, Cancellation & No-Shows
- We make every effort to arrive on time and ask that you be ready with your documents and identification at the scheduled time.
- Please provide as much notice as possible if you need to cancel or reschedule.
- For cancellations made with little notice, or if the signer is not present or not ready at the appointment, a travel or trip fee may apply to cover the time and travel already committed.
6.Right to Refuse or Decline Service
By law and professional standards, we must decline to perform a notarization if, in our reasonable judgment, any of the following apply:
- The signer cannot present satisfactory identification;
- The signer does not appear to understand the document or to be signing willingly;
- The signer appears to lack the capacity to sign, or appears to be under duress or coercion;
- The document is incomplete, or the act requested would be unlawful or improper; or
- We have a reasonable belief that the transaction may be fraudulent.
Declining service in these circumstances is required of every notary and does not constitute a breach of these Terms.
7.Confidentiality
We treat the documents and information you share with discretion and handle them in accordance with our Privacy Policy. Please note that notarial journal entries and RON records are subject to legal retention and disclosure requirements.
8.Limitation of Liability
Our services are limited to the proper performance of authorized notarial acts. To the fullest extent permitted by law, Ambience Notary's total liability arising out of or relating to our services shall not exceed the fees you paid for the specific service at issue. We are not responsible for the content, accuracy, legality, or sufficiency of any document presented for notarization, for the actions of any third party, or for delays or failures caused by circumstances beyond our reasonable control. Nothing in these Terms limits any liability that cannot be limited under applicable law.
9.Indemnification
You agree to indemnify and hold harmless Ambience Notary from claims, damages, or expenses arising from your breach of these Terms, your misrepresentation of identity or document content, or your misuse of our services.
10.Website Use
The content on our website is provided for general informational purposes only and does not constitute legal advice. We strive to keep information accurate and current but make no warranties as to its completeness. You may not use our website in any unlawful manner or attempt to disrupt its operation.
11.Governing Law
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. Any dispute relating to these Terms or our services shall be subject to the jurisdiction of the courts located in Kaufman County, Texas, except where applicable law provides otherwise.
12.Changes to These Terms
We may update these Terms from time to time. Updates will be posted on this page with a revised effective date, and your continued use of our services after changes are posted constitutes acceptance of the updated Terms.
